FBKMarketing Terms and Conditions for Customers
Welcome to FBKMarketing! These Terms and Conditions ("Terms") govern your use of our social media management services. By signing up for our services, you agree to comply with and be bound by these Terms. Please read them carefully.
1. Service Overview
FBKMarketing offers a comprehensive social media management service for $1990 per month. Our service includes content creation, strategic posting, and account management designed to enhance your social media presence. The services are provided on a month-to-month basis, and all content is tailored to align with your brand and business goals.
2. Access to Social Media Accounts
To effectively manage your social media presence, you are required to provide FBKMarketing with full access to your social media accounts. This includes connecting your accounts to our management platform, granting us permissions to post content, engage with followers, and analyze account performance on your behalf. Failure to provide necessary access may result in delayed or incomplete service.
3. Information Sharing and Third-Party Access
FBKMarketing may share your information with trusted third-party vendors and service providers to facilitate content curation, posting, and analysis. These third parties are obligated to protect your information and use it only for the purposes for which it was provided. Affiliates of FBKMarketing may also have access to your information as part of the service delivery process.
- Purpose: The information shared with third-party vendors will be used solely for the purposes of fulfilling the Services outlined in this Agreement, including but not limited to content creation, management, and analytics.
- Confidentiality: Third-party vendors are obligated to maintain the confidentiality of all Customer information and are prohibited from using such information for any purposes other than those expressly permitted by FBKMarketing.
- Customer Consent: By agreeing to these Terms, you consent to FBKMarketing sharing your information with third-party vendors as necessary to perform the Services.
FBKMarketing remains fully responsible for the actions of any third-party vendors it engages and will ensure that all third-party activities comply with the terms of this Agreement.
4. Content Ownership and Usage Rights
All content created by FBKMarketing for your social media accounts is owned by you upon full payment of our services. You have the right to use, modify, and distribute this content as you see fit. However, FBKMarketing reserves the right to showcase the work we have done for you as part of our portfolio unless you explicitly request otherwise in writing.
5. Billing and Payment
- Our services are billed on a recurring basis every 30 days. By signing up for our services, you authorize FBKMarketing to charge the payment method you have provided.
- All payments are due on the first day of each billing cycle and are non-refundable. Failure to pay may result in the suspension or termination of services. No credits will be issued for partial months of service.
- Any payment not received within 7 days of the due date shall accrue interest at the rate of 1.5% per month or the maximum allowed by law, whichever is lower.
- In the event of non-payment, FBKMarketing reserves the right to suspend Services until payment is made in full. If payment is not received within 30 days, FBKMarketing may terminate this Agreement immediately and pursue legal action to recover outstanding amounts.
6. No Refunds
Due to the nature of our services, FBKMarketing does not offer refunds. Once a payment is processed, it is considered final. By agreeing to these Terms, you acknowledge and accept this policy.
7. Customer Responsibilities
As a customer, you are responsible for providing accurate and up-to-date information required for the performance of our services. You agree to cooperate fully with FBKMarketing in the creation, scheduling, and posting of content. Failure to provide necessary information or cooperation may result in delays or the inability to fulfill our service commitments.
8. Service Modifications and Termination
- FBKMarketing reserves the right to modify, suspend, or terminate our services at any time. If we make significant changes to the services or these Terms, we will notify you in advance.
- If you choose to terminate your services, you must provide written notice at least 30 days prior to the end of your current billing cycle.
- Either party may terminate this Agreement with 30 days' written notice to the other party.
9. Limitation of Liability
FBKMarketing shall not be liable for any indirect, incidental, or consequential damages arising from the Services provided, even if advised of the possibility of such damages. FBKMarketing's total liability under this Agreement shall be limited to the amount of fees paid by the Customer in the one month preceding the event giving rise to the liability. FBKMarketing shall not be liable for any delay or failure to perform its obligations under this Agreement if such delay or failure is due to causes beyond its reasonable control, including but not limited to acts of God, war, terrorism, strikes, labor disputes, or governmental orders.
10. Indemnification
The Customer agrees to indemnify, defend, and hold harmless FBKMarketing, its officers, directors, employees, and agents from and against any and all claims, liabilities, damages, losses, or expenses, including reasonable attorneys’ fees and costs, arising out of or in connection with the Services provided under this Agreement, except to the extent caused by FBKMarketing's gross negligence or willful misconduct.
11. Governing Law
These Terms are governed by and construed in accordance with the laws of the State of New Hampshire. Any disputes arising from these Terms will be resolved in the courts of Nashua, New Hampshire.
12. Data Protection and Privacy
FBKMarketing is committed to protecting your privacy. We will handle your personal data in accordance with all applicable data protection laws. Any data collected during the provision of services will be used solely for the purpose of delivering the agreed-upon services and will not be shared with third parties without your consent, except as outlined in the Information Sharing section.

13. Intellectual Property Rights
All intellectual property rights in any content or materials created by FBKMarketing in the course of providing the Services shall remain the exclusive property of FBKMarketing unless otherwise agreed in writing. The Customer is granted a limited, non-exclusive, non-transferable license to use the deliverables solely for its internal business purposes upon full payment of all amounts due to FBKMarketing.
14. Force Majeure
Neither party shall be liable for any failure or delay in performance under this Agreement due to circumstances beyond its reasonable control, including but not limited to acts of God, natural disasters, war, terrorism, or governmental actions. In the event of such a force majeure event, the affected party shall notify the other party as soon as practicable.
15. Non-Solicitation
During the term of this Agreement and for a period of one (1) year thereafter, the Customer agrees not to directly or indirectly solicit or hire any employee, contractor, or consultant of FBKMarketing without FBKMarketing's prior written consent.
16. Amendments
This Agreement may be amended only in writing and signed by both parties. Any modifications to these Terms will be communicated in advance and will require your consent before taking effect.
17. Entire Agreement
These Terms constitute the entire agreement between the parties and supersede all prior agreements, understandings, and representations, whether oral or written.
18. Severability
If any provision of these Terms is found to be invalid or unenforceable, the remaining provisions shall continue to be valid and enforceable.
